ABHC Booking Terms and Conditions

Auckland Bus Hire Company (ABHC) is the trading name of North Harbour Coaches Ltd (NHC), which is the holder of a Passenger Services Licence to provide bus and coach transport services throughout New Zealand. All bookings are accepted subject to the following terms and conditions and by confirming your booking you accept that these terms and conditions will apply.

 

All Quotes, only valid for 5 working days. All Quotes are done by email only ! Verbal Quotes are not Valid.

 

Rates & Driving Hours

  1. The rate charged is appropriate to the bus or coach category and capacity. Requested variation to the school bus or coach from that originally quoted is dependent on availability and any change in cost.
  2. Prices (NZ$) are current at the time of quotation and subject to availability at time of booking. All quoted prices exclude GST (15%), unless stated otherwise. ABHC reserves the right to pass on, without notice, any increases that may occur in any applicable airport charges, road tolls, entry fees or parking charges or fines.
  3. The quoted rates include the services of a Bus or Coach Driver.
  4. The rates quoted are in New Zealand Currency (NZ$).
  5. Should additional kilometres or time be incurred on the day of the hire by the hirer, the Company reserves the right to adjust the quoted rate accordingly. The quotation is given on the understanding that the driving hours comply with current New Zealand legislation. This being as follows:

Payments, Deposits & Late Payments

  1. Payment, in full, is required 7 days prior to departure unless written approval has been granted by the Company for credit terms to apply. In such event, settlement in full must be made by the 20th of the month following the debit of the charge.
  2. ABHC require a deposit payment of 20% of total quote or $100 non-refundable deposit (whichever is greater). If Deposit is not received within 3 working days of your acceptance, ABHC reserves the right to cancel booking without notice.
  3. Full and final payment is due 4 working days prior to the date of travel. In some cases and solely at the discretion of ABHC, a written agreement may be given to accept payment to driver on date of travel. Credit facilities are available on written application to ABHC for regular users and approval is at the sole discretion of ABHC in all cases.
  4. Any outstanding amounts that have not been paid before the agreed settlement date will incur a 3% Late Payment Fee. This fee will accrue once every 7 days that the full invoiced amount remains unpaid.
  5. A 4% Administration fee will apply to all Credit Card Payments.

Cancellations

  1. The event that you cancel your booking, ABHC reserves the right to charge a cancellation fee as follows;

Amendments

  1. Any amendments you make to your booking after confirmation can only be accepted subject to availability. ABHC reserves the right to charge an amendment fee in respect to each and every amendment in addition to any other applicable charges in relation to each amendment.

Liability & Responsibility

  1. (ABHC) The Company will ensure every reasonable effort is made to carry out the hirer's requirements and no responsibility is accepted for additional costs caused by delays occasioned by changes in road conditions or deviations from normal routes, floods or other unusual circumstances, industrial action, sickness of staff or passengers. The Company reserves the right to substitute alternative equipment at its option in the event of unanticipated circumstances which necessitate a change.
  2. (ABHC) The Company does not accept responsibility for loss or damage to property left in a vehicle. Passengers leaving property in the coaches do so entirely at their own risk.
  3. Quotations are given and orders confirmed subject to availability of vehicles at the respective times of quotation and confirmation.
  4. Quotations are based on the shortest suitable route unless otherwise stated.
  5. Section 38 of the Summary Offences Act 1981 states "that there is a total ban on the consumption of alcohol on any passenger service vehicle including vehicles on charter". Based on the above statement the Company must enforce this with a policy banning the consumption of alcohol on all our vehicles. We regret the inconvenience this may cause but trust that you will understand the position we must take.
  6. The hirer is liable for the first $800 per wilful or reckless damage that occurs to the vehicle over the duration of the hire.
  7. ABHC has no liability for any act, omission or default, whether negligent or otherwise of any staff member, supplier or third party. ABHC have no liability for any loss or damage caused by any mechanical failure of any bus or coach’s use on your work. In circumstances where liability cannot be excluded, such liability is limited to the value of the agreed and purchased travel arrangements.
  8. ABHC reserve the right to pass on your confirmed booking to an affiliated Bus or Coach Company under any circumstances that ABHC deems necessary.

Drivers Meals & Accommodation

  1. Should you agree to organize accommodation for our driver then it must be in a private room with ensuite facilities and meet a standard that is acceptable to ABHC in all cases. The driver can decide to accept lesser accommodation if he/she so wishes.
  2. All meals must be supplied that meet food industry standards.
  3. Should you not provide the accommodation and meals then ABHC will provide them and the costs will be added onto the quoted price and form part of your contract with ABHC, which you accept liability for.

Other Conditions of Booking

  1. Food & Beverage Consumption; these are not to be consumed on any vehicle without prior approval. In such circumstances (of approval being given) payment of a bond may be required to cover the risk of damage to the vehicle. Your responsibilities for any damage are in accordance with these terms and conditions.
  2. Smoking; Smoking is not permitted by law on any vehicle supplied by ABHC.
  3. Damage to Vehicle; you are responsible for any damage caused to a vehicle as a direct result of any action or non-action taken by any passengers while travelling as a result of your booking. You will not be responsible for payment of any damages caused by an employee of ABHC or its suppliers. In all cases the driver of any vehicle will have the discretion to stop the vehicle and disembark those passengers engaging in unacceptable or unruly behaviour.
  4. Soilage Charges; The current charge for ABHC cleaning up any soilage is $200 and is subject to increase without notice. This applies to any soilage no matter of cause or type.

  6. A Confirmation and Booking of ABHC service’s is deem that you are in agreement of ABHC Terms & Conditions.
